Argentina incorporates various MERCOSUR phytosanitary regulations

The National Government has made official this Wednesday (19.03.2025) the incorporation of various Resolutions of the Common Market Group (GMC) of MERCOSUR regarding general phytosanitary requirements through the Resolution 290 / 2025This measure seeks to harmonize national regulations with regional standards, in compliance with the commitments made during the integration process of the Southern Common Market.

According to the explanation, the MERCOSUR integration process, created by the Treaty of Asunción in 1991, is of strategic importance to the Argentine Republic. Under the 1994 Ouro Preto Protocol, regulations issued by its governing bodies must be incorporated into the legal system of the Member States. According to Decision 20/02 of the Common Market Council, regulations that do not require legislative approval may be adopted through executive branch resolutions.

In this framework, Resolution 290/2025 adopts six GMC regulations that update and optimize the regulation on phytosanitary matters, aligning with the Agreement on the Application of Sanitary and Phytosanitary Measures (SPS) of the World Trade Organization (WTO).

Main provisions

The new resolution establishes the incorporation into the Argentine legal system of the following MERCOSUR regulations indicated in the annexes:

  • GMC Resolution 23/2021: Repeals GMC Resolution 11/02, regarding guidelines for non-compliance notification and emergency action.
  • GMC Resolution 24/2021: Repeals GMC Resolution 56/01, which contained the glossary of phytosanitary terms.
  • GMC Resolution 25/2021: Repeals GMC Resolution 55/01, relating to the requirements for the establishment of pest-free areas.
  • GMC Resolution 26/2021: Repeals GMC Resolution 49/05, which regulated the procedure for the approval of quarantine treatments.
  • GMC Resolution 27/2021: Repeals GMC Resolution 50/05, on quarantine treatments in MERCOSUR.
  • GMC Resolution 28/2021: Repeals GMC Resolution 2/94, which established the harmonization of seed analysis methodologies.

The regulation also specifies that, to this end, the National Service for Agri-Food Health and Quality (SENASA) and the National Seed Institute (INASE) have intervened in the implementation of these regulations, ensuring their effective application throughout the country.

In this way, Argentina strengthens its commitment to regional integration and the modernization of its phytosanitary regulatory framework, promoting standards in line with international guidelines.
