The Ministry of Economy, through the Resolution 1131 / 2024, ordered the opening of the examination due to the expiration of the term of the antidumping measure established by Resolution No. 1.283 of November 21, 2019 of the then Ministry of Production and Labor. This measure applies to exports to the Argentine Republic of "Domestic aluminium radiators for central heating, non-electric heating"originating from the Italian Republic and the People's Republic of China.
The request for review of the antidumping measure was submitted by the firm ACQUATERM SRL and PEI SA, before the Undersecretariat of Commercial Policy and Management (SSPYGC).
According to information added to the file by these companies, the Directorate of Unfair Competition, under the National Directorate of Foreign Trade Management of the Undersecretariat of Foreign Trade of the Ministry of Economy, evaluated the domestic price information of the Italian company RADIATORI 2000 SPA and of the People's Republic of China, to establish a comparable normal value. The FOB export prices to Argentina were obtained from the Undersecretariat of Foreign Trade, while the prices to third markets were provided by the requesting firms.
According to Decree No. 1.393/2008, the National Foreign Trade Commission reported that the application submitted had no errors or omissions. In addition, on September 9, 2024, the The Undersecretariat of Foreign Trade concluded that the conditions for opening an examination due to the expiration of the current antidumping measure were met, imposed by Resolution No. 1.283/2019, on aluminum radiators of Italian and Chinese origin.
The analysis revealed a dumping margin of 109,07% for RADIATORI 2000 SPA exports to Argentina and a recurrence margin of 42,31% for Chile. For the rest of Italy, the dumping margin for Argentina is 155,37% and for Chile 42,31%. No exports were recorded from China to Argentina, although a recurrence margin of dumping of 48,10% was estimated for its exports to Peru.
The report was forwarded to the National Commission for Foreign Trade (a specialized agency in the analysis of material damage to national production in the situations provided for in the current legislation on international trade in Argentina), which on September 27, 2024 considered that there was sufficient evidence to justify the initiation of a review of the antidumping measure, given the likelihood that the damage will occur again in the future.
In addition to the above, the National Commission for Foreign Trade clarified that, despite the context of market contraction, the national industry has managed to increase its participation and improve its real prices, reaching profitability levels above the reference average for the sector. For this reason, It was decided not to keep the anti-dumping measure in force while the investigation is being carried out., given the good performance of the local industry in satisfying a significant part of domestic demand.
