ARCA establishes new guidelines for safeguarding customs information

The Customs Collection and Control Agency (ARCA) establishes new guidelines for the safeguarding of information on foreign trade, updating the current 2018 regulations regarding the publicity and confidentiality of import and export data, effective as of today, Monday, October 27.

This is established by the Provision 219/2025, published in the Official Gazette, through which ARCA defines the guidelines for the advertising and provision of customs information, while reaffirming the protection of trade secrets.

The regulations clarify which public bodies and through what mechanisms can access confidential information. collected by the agency during its functions of controlling international merchandise traffic. Among the new features, the Agency clarified that the delivery of data to Justice within the framework of ongoing investigations, covering all jurisdictions, unlike the previous regulations.

Likewise, the obligation to periodically publish import price lists remains in place as a tool to detect and combat dumping practices. This publication is made pursuant to Article 711 of the Customs Code and includes all import applications for consumption, both pending and new, related to the tariff items under investigation.

Specific details on managing advertising and providing information are found in the Annexes to Provision IF-2025-03844964-ARCA, which are an integral part of the standard and establish the criteria that all areas of the organization must follow.
