The Secretariat of Agriculture, Livestock and Fisheries of the Nation made official today (14.12.2022), an exceptional automatic extension of 180 calendar days to the Declarations of Foreign Sales (DJVE) of corn, as a consequence of the great drought that affects the entire territory of the Argentine Republic, which has reduced cereal yields.
The measure was established in the Resolution 182 / 2022 whose text indicates that "a Exceptional Automatic Extension of ONE HUNDRED AND EIGHTY (180) calendar days, to the Foreign Sales Affidavits (DJVE) with expiration of the declared shipping period, plus the automatic extension, during the months of December 2022, January and February 2023 for the merchandise included in tariff item No. 1005.90.10 (GRAIN CORN), counted from the end of boarding plus automatic extension. The period arising from the above will constitute the new maximum period of validity of the DJVE.”
The measure clarifies that "it will not apply to those Foreign Sales Declarations that were registered after the entry into force of this measure, nor to DJVEs that are registered with a validity period of 30 days."
The decision was made "as a result of the severe drought affecting the entire territory of the Argentine Republic and the need to adopt specific measures to contain the consequences that this could cause and its implications for agricultural exports."
"In order to ensure the normal supply of the domestic market, it is clear that a substantially lower production is expected, therefore, it is necessary to adopt concrete measures in order to minimize the consequences," he added.
Furthermore, the same reasons of force majeure may be alleged by producers in the event of non-compliance with the exporters, who must admit this circumstance.
For its part, the Undersecretariat of Agricultural Markets may issue the complementary and clarifying regulations that are necessary for the implementation, as well as the future adjustments that are essential to maintain the normal flow of the export operation of agricultural products included within the regime of Law No. 21.453.
