AFIP simplifies procedures for transfer pricing information

The Federal Public Revenue Administration (AFIP) simplifies the number of mandatory transfer pricing forms in foreign trade operations, while raising the minimum amounts to be reported, through 4496 / 2019 resolution which was made official in the Official Gazette this Monday (27.5.2019).

The provision enables the postponement of the due date corresponding to next week, of form 969, which will ultimately be eliminated from the general procedure for transfer pricing information, i.e. on reference values ​​for operations between companies, whether from the same business group or not, thus avoiding price alterations in the market. 

AFIP explained that the expiration of all forms will be unified in the eighth month after the end of the fiscal year, instead of the current deadlines of the fifth, sixth and eighth month, and therefore, the three deadlines will be unified; for example, in the case of companies that closed last December, the presentation will be next August.

Minimum amounts for the obligation to file declarations are raised Regarding transactions between independent entities, the obligation to report will be for those who have operated for 10 million pesos or more, as opposed to the previous limit of $1 million; and in the case of transfer prices, the minimum limit for each transaction will be 300 thousand pesos or, if lower, an amount of 3 million pesos. 

Finally, the remaining regulatory and system changes to adapt the reporting regime for international operations and transfer prices to the latest tax reform (Law 27.430) and the benefits scheme of the Organization for Economic Cooperation and Development (OECD) are expected to be available to citizens next month.
