Ships and planes for international transport between China and Chile will be exempt from VAT

The General Office of the State Tax Administration issued a document on April 14 to interpret the "Announcement by the State Administration of Taxation on the Amendment and Implementation of the Protocol on the Agreement between the Government of the People's Republic of China and the Government of the Republic of Chile on the Prevention of Double Taxation and Tax Evasion" , indicating that China will exempt Chilean companies from income derived from the international transportation business by ships or planes in China, and Chile will also give our international transportation companies the same treatment.

It is understood that the "Protocol on the Agreement between the Government of the People's Republic of China and the Government of the Republic of Chile on the Avoidance of Double Taxation and Tax Evasion" was formally signed on May 29, 2018 in Santiago, Chile.

Article 1 of the Protocol stipulates that Companies of the Contracting State engaged in international transport business in the other Contracting State by ship or aircraft shall be exempt from VAT in the other Contracting State. The State Administration of Taxation stated that, in accordance with the regulations, China will exempt Chilean companies from income derived from international shipping or air transportation business in China, and Chile will also grant the same treatment to international shipping companies from China.

Please note that, pursuant to Article 2, the Protocol applies to income derived from 1 January 2017.
